Simply Eryka Photography (SEP) reserves the right to use any photograph/video taken at an event sponsored by SEP, without the expressed written permission of those included within the photograph/video. SEP may use the photograph/video in publications or other media material produced, used or contracted by SEP including but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, etc. Unless requested otherwise by “The Client” in writing.

To ensure the privacy of individuals and children, images will not be identified using full names or personal identifying information without written approval from the photographed subject, parent or legal guardian

The client working with that does not wish to have their images recorded for distribution should make their wishes known to SEP, and/or the event organizers, and/or contact SEP via email (info@simplyerykaphotography) in writing of his/her intentions and include a photograph. SEP will use the photo for identification purposes and will hold it in confidence.

By participating in a SEP event or by failing to notify SEP, in writing, your desire to not have your photograph used by SEP, you are agreeing to release, defend, hold harmless and indemnify SEP from all claims involving the use of your picture or likeness.

Any person or organization not affiliated with SEP may not use, copy, alter or modify SEP photographs, graphics, videography or other, similar reproductions or recordings without the advance written permission of an authorized designee from SEP.

Digital Image License:

Your purchase of a Digital Image provides you with the License for specific usage rights as listed below.

License Agreement:

This License Agreement is made between you and Simply Eryka Photography (SEP). By downloading or using the Licensed Images, you accept the terms of this License. If you do not agree to the terms of this License, do not download or use the Licensed Images.

Grant of license & Permitted Uses:

This Digital Image License is specifically intended for personal use and provides a non-exclusive, non-transferable, single-user (1 individual person) license, lasting for the lifetime of the Licensee.

All other content on this website and connected is owned by SEP. Except as expressly authorized by Simply Eryka Photography (SEP) herein, you agree not to copy, modify, rent, lease, loan, sell, assign, distribute, license, reverse engineer, or create derivative works based on the Website or any content (including, without limitation, any software) available through the Website.

You are NOT permitted to alter the images in ANY way, including but not limited too black and white or sepia conversions and cropping. NO alterations are permitted. This license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, contests or resale of any nature.

The delivery of the digital files releases the Photographer from any liability due to loss or damage of the images and releases the Photographer from any obligation to maintain copies of any digital file, image, or photograph.
